Terms and conditions 1. Putting our arrangement in place
i) In this Agreement, we are Shortbred and you are the person detailed on the order forms.
ii) Our Agreement is made on the date we deduct payment from your credit/debit card the details of which you provided on the order form.
iii) Our Agreement includes all correspondence from us to you and the descriptions of the Goods as provided by us on our Website or otherwise.
2. Making your choice and ordering
i) Peruse our Website and select your chosen products.
ii) Complete the order form in full and follow the instructions detailed on the Website.
iii) The pictures may not be a true representation of the item, and colours may vary in certain cases. 3. What happens next?
i) If your chosen products are in stock your order will be processed. We will deduct the price payable for your chosen products from your nominated credit/debit card and your chosen products will be despatched to you.
ii) Should you not receive your chosen products within 7 days of us confirming their availability to you, please contact us to let us know. You will then be given the choice of:
a) cancelling your order whereupon we will refund the price you paid or
b) requesting that we despatch further products to you (subject to availability) on the basis that you return one set of the products you receive should you receive two sets or
c) wanting a further agreed time period after which if your chosen products have not been received then options a) or b) will be available to you. iii) Should you choose option a) then your refund will be made to the credit/debit card you nominated on your order form.
4.Terms of Sale
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays for which we will not be responsible. Please see our Delivery Charges notice for further information.
In order to contract with Shortbred you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Shortbred retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
Our Contract
When you place an order, you will receive an acknowledgment e-mail confirming receipt of your order: this email will only be an acknowledgment and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the "Total Cost".
Payment
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
Discount Codes
i) Account discount codes - Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account in respect of which the discount code was offered and registered.
ii) Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website.
The conditions of use relating to any discount code will be specified at the time of issue.
5. RISK AND PROPERTY
i) Risk of damage to or loss of your chosen products shall pass to you on delivery of them.
ii) Notwithstanding delivery and the passing of risk in your chosen products or any other provision of this Agreement property in your chosen products shall not pass to you until we receive cleared funds payment in full of the price of your chosen products.
6. WARRANTIES
i) We warrant that you will be entitled to the benefit of any warranties or guarantee given by you the suppliers to us of your chosen products. This does not affect your statutory rights.
ii) You warrant that the information entered onto the Order Form is true.
iii) Where we sell to you under a consumer transaction (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976) your statutory rights are not affected by this Agreement.
7. FORCE MAJEURE
We shall not be liable to you or be deemed to be in breach of this Agreement by reason of any delay in performing or any failure to perform any of our obligations if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond our reasonable control:-
i) Act of God explosion flood tempest fire or accident;
ii) war or threat of war sabotage insurrection civil disturbance or requisition;
iii) acts restrictions regulations bye-laws prohibitions or measures of any kind on the part of any governmental parliamentary or local authority;
iv) import or export regulations or embargoes;
v) strikes lock-outs or other industrial actions or trade disputes (whether involving employees of us or of a third party);
vi) power failure or breakdown in machinery.
8. GENERAL
i) If any provision of this Agreement is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.
ii) The Contract shall be governed by the laws of England.
